Updates to SEPA Guidance On Financial Provision and Technical Competence

The following updates have been made from Scottish Environment Protection Agency (SEPA) outlining two pieces of guidance on Financial Provision and Technical Competence at waste facilities.

1. Financial Provision for Non-Landfill Waste Management Activities

  • Additional information about the types of financial provision that may be appropriate in certain circumstances.

  • Information on a spreadsheet which is available to assist with calculating appropriate levels of financial provision in most cases using our indicative multipliers.

  • Increased the scope of the circumstances which could merit the use of different multipliers.

  • Clarified for some waste authorisations for recovery operations, financial provision will be based on projected restoration costs, rather than site clearance costs.

  • Options for SEPA to re-assess financial provision and to require additional or alternative financial provision during the lifetime of a waste authorisation in limited circumstances.

2. Guidance regarding provision and Assessment of Technically Competent Management at Waste Management Facilities 

  • Clarified the guidance will also be appropriate for waste management activities covered by Pollution Prevention and Control authorisations.

  • Clarified the operator or applicant does not need to be the technically competent person.

  • An additional example of where previous compliance issues at other sites (including out with Scotland) may affect a technical competence assessment.

  • Further clarification on the applicability of the bespoke technical competence assessment.
