Scottish Government publish regulations to ban the sale disposable vapes from 1st April 2025

The Scottish Government has announced plans to ban the sale of disposable vapes in Scotland. The Draft Environmental Protection (Single-use Vapes) (Scotland) Regulations 2024 outlines plans to implement the ban from 1st April 2025.

This will form part of a UK wide ban on the product, that will likely come into force across the UK on a similar timetable.

From that date, it will be an offence for a person or business, to supply, offer to supply, or have in their possession for supply, single-use vapes. Those found in breach will be subject to a summery conviction of up to 2 years or/and a fine.

In addition to the draft regulations, the Scottish Government has published an online consultation consisting of the two question set out below (open until 8th March 2024):

1. Do you have any feedback on the draft regulations to prohibit the sale and supply of single-use vapes in Scotland?

2. Do you have any concerns about how these regulations would work in practice?
